Flat imbalance claim rejected

The erection of nine flats on the site of a former public house in Kent was permitted despite the council's claim that it would lead to an imbalance of such accommodation in the area.

The council accepted that there was a need for flats but asserted that there would be an adequate supply from other developments. It had adopted a policy which therefore favoured the development of houses and highlighted support for this approach in a consultation core strategy document.

An inspector decided that she could give this policy limited weight because it had yet to be adopted. The appeal site lay within an area of predominantly single family dwellings and would therefore offer greater choice in the locality. The existing public house had been demolished and the scheme would make use of a brownfield site in the urban area.
