Guidance on Planning Propriety Issues

Following the commencement of the predetermination provision in the Localism Act 2011, an updated version of the planning propriety guidance has been published. This guidance relates to the Secretary of State's planning decision making functions.

This guidance note concerns propriety issues that can arise when the Secretary of State exercises decision-making functions under the planning legislation - in particular decisions on planning appeals made to the Secretary of State, and applications which are called in for decision by the Secretary of State.

This replaces the Guidance on Planning Propriety Issues published on 6 October 2008. The guidance note can be downloaded here.
